What Is A Subclass 870 Visa?

Sponsored Parent Visa (Subclass 870) is a temporary visa that allows a parent of an Australian permanent resident, Australian citizen, or an eligible New Zealand citizen to visit Australia and live here for up to three or five years. The application must be made by an Internet application. An Applicant may be in or outside Australia at the time of grant of this visa (but not in immigration clearance).

You can lodge this subclass 870 visa offshore as well as onshore. For instance, if you are onshore (in Australia) and hold a Visitor (subclass 600) visa that does not have an 8503 (No Further Stay) condition imposed on it then you can lodge this subclass 870 visa.

 

You can also lodge it after lodging a valid Contributory Parent (subclass 143) visa application (but not the other way around). Or, you can apply for an offshore Visitor visa and, if granted, you can then later apply for an onshore subclass 870 visa.

What You Need to Know About Subclass 870 Visa

  • Subclass 870 visa application involves a two-step process.

  • In the first step, the parent-sponsor (the Sponsor who wishes to sponsor the parent) must apply to the Minister to get the Parent-Sponsor application approved BEFORE lodging an application for this visa.

  • Once the Sponsorship application is approved, the parent must lodge the visa application within six months of the sponsorship approval.

  • You will not have work rights.

Eligibility of Applicant For Subclass 870 Visa

To satisfy the eligibility requirements, the applicant/parent must be:

  • Genuinely intending to visit Australia temporarily.

  • Either the biological, step, or adoptive parent of the Sponsor/child.

  • The Sponsor must be an Australian permanent resident, an Australian citizen, or an eligible New Zealand citizen.

  • Able to secure suitable health insurance for the duration of the visa.

  • Able to pass health examinations and character-related tests.

  • Outside Australia for at least 90 days if the last Australian visa held was a subclass 870 visa.

Eligibility Requirements For An Approved Parent Sponsor

  • Sponsor must be willing and able to comply with all the sponsorship obligations (including sharing of any adverse information with the applicants);

  • The sponsor must be either a biological, step or adoptive child of the applicant/parent;

  • Sponsor must be at least 18 years of age;

  • Sponsor must be earning at least AUD$83,454.80 (before tax) per income year;

  • Sponsor must not have failed in meeting his/her previous sponsorship obligations;

  • Sponsor must not have any unpaid debts owed to the Commonwealth or any other public health institution;

  • Sponsor must be able to satisfy the good-character requirements (which may be satisfied by providing police clearance certificates from each country in which Sponsor has spent more than 12 months in total in the last 10 years)

Consider This

  • This Sponsored Parent Temporary Visa involves certain time-frames (e.g., 60 days or 6 months - depending upon your location) in which an Applicant may be sponsored by their child/Sponsor after the Sponsorship has been approved by the Minister;

  • Not providing sufficient evidence and information along with your visa application may prolong the processing times;

  • This visa application requires a significant amount of information and a good deal of evidence to support your and your Sponsor’s claims;​

  • Satisfying a Visa Officer that you meet all the requirements of this visa often requires careful planning, and well-drafted personal statements, etc. You must collect all the information and evidence that may prove your claims of genuineness and support your visa application.

  • To avoid surprises, you must consider beforehand whether your Sponsor is able to comply with all the Sponsorship obligations. 

Length of Stay On Sponsored Parent Visa - Subclass 870

Subclass 870 visa allows you to stay in Australia either for 3 years or 5 years. The duration of the visa will depend upon the application you make and the fee you pay.

Note: When applying for a subclass 870 visa, the Applicant will only have to pay the base application charge (AUD 1,145). The Department will advise the applicant to pay the remaining fee (known as the ‘second instalment’) before the visa is granted.
